PUBLIC CHILD LAW

Alastair deals with the extremely sensitive matter of state applications for care orders and adoption orders. He represents mothers, fathers, grandparents, guardians and the state in such applications before the courts

PRIVATE CHILD LAW

Alastair represents parents in applications for child arrangements orders. These are court orders which stipulate who a child will live with and how much time the child will spend with the non-resident parent. He further, deals with prohibited steps orders and specific issue orders

DIVORCE

Divorce is an extremely difficult and emotional time and unfortunately 50% of married couples go through this each year. Alastair represents clients in financial proceedings where agreement cannot be reached as to the division of assets upon divorce.

INTERNATIONAL CHILD ABDUCTION

If a child is abducted to another country

by a parent (depending upon the country to which the child has been taken there are swift remedies under the Hague and Brussels II conventions and using the inherent jurisdiction of the High Court to ensure the return of the child. Alastair is experienced in making and resisting such applications.

INJUNCTIONS

Under the family law act 1996 a party a 'connected person' in a relationship may apply for an Occupation Order. This is a draconian order which can result in a party being ordered to vacate their own house. Non Molestation orders can also be applied for. These are essentially restraining orders preventing one party from 'harassing' the other. Alastair is experienced in making and resisting such applications

DISPUTE RESOLUTION

As an accredited mediator, Alastair can assist conflicting parties in using mediation to reach an agreement therefore negating the need for expensive court costs
